Terms of Service

Welcome to Bizi. By using our service at biziedit.com, you agree to these Terms of Service. Please read them carefully.

1. Service Description

Bizi provides an automated AI-powered photo enhancement service for real estate listings. Our service allows you to:

  • Upload real estate photographs
  • Receive AI-enhanced versions with improved lighting, sky enhancement, and clutter removal
  • Download enhanced images for use in property listings

Important: All image editing is performed by automated artificial intelligence systems. No human editors review or modify your images. The AI processing is provided through third-party services (OpenAI).

2. Account Terms

To use Bizi, you must create an account using either:

  • Email address (via magic link authentication)
  • Google OAuth sign-in

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use this service.

3. Pricing and Payment

Bizi operates on a simple pay-per-image model:

  • Standard rate: $2.00 USD per image
  • Free trial: Your first project includes 10 free images
  • No subscriptions: Pay only for what you use

All payments are processed securely through Stripe. We accept major credit and debit cards including Visa, Mastercard, American Express, and Discover.

4. Refund and Redo Policy

We want you to be satisfied with your enhanced images:

  • Free redos: You may request up to 2 free re-edits on any image if you're not satisfied with the result. When requesting a redo, you can adjust enhancement settings.
  • Refund requests: If you remain unsatisfied after using your free redos, contact us at support@biziedit.com to discuss a refund.

Refund eligibility is determined on a case-by-case basis. We do not provide refunds for images that have been downloaded and used in listings.

5. AI-Generated Content Disclaimers

THIS SECTION CONTAINS IMPORTANT LIMITATIONS. PLEASE READ CAREFULLY.

By using Bizi, you acknowledge and agree that:

  • Automated processing may produce errors: AI-based image editing may occasionally produce unintended results, artifacts, distortions, or inaccuracies. The technology is not perfect.
  • No guarantee of accuracy: Bizi does not guarantee that enhanced images will be accurate, suitable for any particular purpose, or free from defects.
  • User review required: YOU ARE SOLELY RESPONSIBLE for carefully reviewing all enhanced images before downloading, publishing, or using them in any listing or marketing material.
  • User responsibility for published content: You accept full and sole responsibility for any content you publish using images edited by Bizi, including in MLS listings, websites, social media, or printed materials.
  • No liability for misrepresentation: BIZI IS NOT LIABLE for any claims of misrepresentation, false advertising, or similar claims arising from your use of AI-edited images in property listings or other publications.
  • No compliance warranty: Bizi does not warrant that edited images comply with MLS rules, real estate advertising standards, fair housing laws, or any other regulatory requirements in your jurisdiction.
  • Enhancement vs. alteration: While our AI is designed to enhance presentation (lighting, sky, clutter removal) without altering the property's actual features, you must verify that the final images accurately represent the property.

6. Intellectual Property

Your content: You retain all ownership rights to the original images you upload. By uploading images, you grant Bizi a limited, non-exclusive license to process, store (temporarily), and enhance your images solely for the purpose of providing our service.

Enhanced images: You own the enhanced versions of your images and may use them for any lawful purpose, including commercial real estate listings.

Our service: The Bizi name, logo, website design, and underlying technology remain our intellectual property.

7. Acceptable Use

You agree to use Bizi only for lawful purposes. You may not:

  • Upload images you don't have rights to use
  • Upload illegal, harmful, or offensive content
  • Use the service to create fraudulent or deceptive listings
  • Attempt to reverse-engineer or exploit our systems
  • Use automated systems to abuse the service
  • Violate any applicable laws or regulations

8. Data Retention

Your uploaded images (both original and enhanced) are stored in your dashboard for 30 days. After 30 days, images are automatically and permanently deleted from our systems. We recommend downloading your enhanced images promptly.

Account data and transaction records are retained as described in our Privacy Policy.

9. Account Termination

By you: You may delete your account at any time through your Account Settings page. Navigate to Account Settings > Danger Zone and follow the confirmation process. Account deletion is immediate and permanent.

What happens when you delete your account:

  • All your personal information is permanently deleted (profile, email, name, company, phone)
  • All your projects and their details are permanently deleted
  • All your uploaded and enhanced images are permanently deleted
  • Your transaction history is permanently deleted

Anonymized data retention: When you delete your account, we retain anonymized aggregate statistics (such as total projects completed and total images processed) that cannot be linked back to you. This data is used for aggregate business analytics and financial reporting. See our Privacy Policy for details.

By us: We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity
  • Abuse the service or our systems
  • Fail to pay for services rendered

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • BIZI IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  • IN NO EVENT SHALL BIZI, ITS OWNERS, OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SALES, LOST DATA, OR BUSINESS INTERRUPTION.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO BIZI IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bizi and its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your publication or use of enhanced images
  • Any claims of misrepresentation related to properties you list using our service

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of Bizi after changes constitutes acceptance of the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Bizi shall be resolved in the courts of Delaware.
